Official Rules
NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL, MUNICIPAL AND PRVINCIAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
The “D-Box Cash Back” Sweepstakes (“Sweepstakes”) begins at 12:00:01 a.m., Eastern Time (“ET”) on July 24th, 2008 and ends at 11:59:59 p.m. ET, on January 30, 2009 ("Sweepstakes Duration"). Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules. Sweepstakes is sponsored by D-Box™ Technologies Inc. ("Sweepstakes Sponsor"), who is solely responsible for all aspects of this Sweepstakes. Sweepstakes consists of a Grand Prize segment only.
This Sweepstakes is open to legal residents of Canada and the 50 United States who are aged 18 years and older. Employees, agents and representatives of D-Box™ Technologies Inc. are excluded, as well as any parent or related company, their advertising and promotion agencies, suppliers of prizes, materials and services related to the Sweepstakes, as well as members of their immediate family (brothers, sisters, children, father, mother), their legal or common-law spouse and all people with whom these employees, representatives and agents reside, whether related or not. The persons selected for the prize agree to sign a statement contained in the Standard Declaration and Release Form to this effect and as well must provide in such Form the name of their employer.
HOW TO ENTER
There are two ways to enter: 1) Visit www.livetheaction.com and enter the serial number (6 to 10 characters) located on the back of the D-Box™ Motion Controller. Complete all registration information (last name, first name, user name, gender, age, complete mailing address, phone number and e-mail address) along with the serial number of the purchased Motion Controller unit, name of retailer, date of purchase and total invoice amount. Read and accept the Official Rules by clicking where it states "I accept" and then click “Submit!” You’ll automatically receive a chance to win the Grand Prize. Failure to accept the Official Rules will prevent you from entering online. Limit of one (1) entry per person, per email address and mailing address for the entire Sweepstakes Duration. To be eligible, all online entries must be received no later than 11:59:59 p.m. ET on the Sweepstakes closing date, January 30, 2009; OR 2) You can enter the Sweepstakes without purchase by hand printing on a 3”x 5” card, your Name, Date of Birth, Address (including zip code), Day & Evening phone numbers, and E-mail address. Mail the card to: "D- Box Cash back Sweepstakes" P.O. Box 4127, Station D, Montreal, Quebec H3C 0J7. Limit of one (1) entry per person, per email address and mailing address for the entire Sweepstakes Duration. All entries must be postmarked by January 30, 2009, and received by February 7, 2009.
All entries received will be entered into the Grand Prize drawing. By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the Sweepstakes Administrator without appeal. Sweepstakes Sponsor and Sweepstakes Administrator are not responsible for lost, late, incomplete, illegible, incorrect, delayed, garbled, undelivered, misdirected, stolen, postage-due registrations, entries or mail. Sponsor reserves the right to disqualify any person, e-mail address or mailing address that submits more than one entry. All entries become the exclusive property of Sponsor and will not be acknowledged or returned.
GRAND PRIZE
There will be one (1) Grand Prize winner. The Grand Prize winner will receive a $10,000 cash award (in the form of a cheque/check in U.S. funds).
DRAW
The random Grand Prize Draw will take place at 2:00 p.m. [EDT], February 9, 2009, at 1751 Richardson Street, Suite 6200, Montreal, Quebec H3K 1G6, by an independent organization responsible for managing the draws. One (1) eligible entry will be selected at random. The odds of winning a Grand Prize will depend on the number of eligible entries received.
CLAIMING OF PRIZE
In order to be declared a winner of the Grand Prize, the selected entrant must meet the following mandatory conditions:
i) He/she must be reached by the Sweepstakes organizers by phone within fifteen (15) days following the draw;
ii) He/she must complete and return (by fax or registered mail) the Standard Declaration and Release Form, within fifteen (15) days of its receipt.
iii) He/she must correctly answer the mathematical skill-testing question on the Standard Declaration and Release Form, without help and within the time limit (This applies to Canadian residents only). For the purposes of these Official Rules, the entrant is, according to the registration procedure (detailed in “How to Enter”), the person whose name appears on the entry form. It is this said person who will be asked the mathematical skill-testing question and to whom the prize will be awarded if they are declared the winner.
Failure to meet any one of the conditions described above will result in the selected entrant’s automatic disqualification, and loss of the right to their prize, and the Sweepstakes organizers will proceed with a new random draw until a winner is determined.
The prize will be delivered to the winner within six (6) to eight (8) weeks after the Sweepstakes organizers have received their properly completed Standard Declaration and Release Form. The Prize must be accepted as described in these Official Rules and cannot be transferred, substituted or exchanged.
PERSONAL INFORMATION
By entering this Sweepstakes, entrants consent to the collection, use and disclosure of their personal information for the purposes of administering the Sweepstakes. By accepting the prize, the winner consents to the collection, use and disclosure to the public of their names, addresses (city/province or city/state), voices, statements and photographs or other likenesses for publicity purposes in connection with the Sweepstakes in any media or formats, including but not limited to the Internet, without further notice, permission or compensation. Except as otherwise set out in these Official Rules, no communication (commercial or otherwise), that is not related to this Sweepstakes, will be sent to entrants by the Sweepstakes Sponsor, except if the entrant has otherwise authorized the Sweepstakes Sponsor, or its affiliated companies, when appropriate to do so. Personal information will not otherwise be used or disclosed without consent.
RELEASES
The selected entrant releases the Sweepstakes Sponsor, as well as its affiliates, advertising and promotional agencies, their partners, their employees, agents and representatives from all responsibility for any damage sustained as a result of the acceptance and use of their prize. In order to be declared a winner, and prior to receiving his/her prize, the selected entrant agrees to sign a Standard Declaration and Release Form to this effect.
The selected entrant acknowledge that, upon receipt of their prize, the
execution of services related to their prize becomes the entire and exclusive
responsibility of the prize supplier and relevant guarantees will be the sole
and exclusive responsibility of the manufacturers, suppliers, distributors or
retailers. In order to be declared a winner, and prior to receiving their
prize, the selected entrant agrees to sign a declaration to this effect, which
will be included in the Standard Declaration and Release Form.
The Sweepstakes organizers and Sweepstakes Sponsor are released from all
responsibility related to the malfunctioning of any software components,
software, lines of communication related to the loss or absence of the
communication network, or related to any failed, misdirected, incomplete,
illegible, or erased transmission by any computer, fax or network, and which
could limit, or prevent, the possibility of any person from entering the
Sweepstakes. The Sweepstakes organizers and Sweepstakes Sponsor are released
from all responsibility for any damage or loss that could be caused, directly
or indirectly, in whole or in part, by downloading any software and by the
transmission of any information required for entry in the Sweepstakes.
CAUTION: ANY ATTEMPT BY AN ENTRANT OR BY ANY OTHER PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SWEEPSTAKES SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.

To request confirmation of the name and address of the winner, please send a self-addressed, stamped business size envelope, by March 15, 2009, to: ASC / “D-Box Cash Back” Sweepstakes Winner List, 300 State St. Suite 402, Rochester, NY 14614.
RIGHT TO TERMINATE
Sweepstakes Sponsor reserves the right, at its sole discretion, to annul, terminate, extend or suspend this Sweepstakes, in whole or in part, in the event of a virus, software bug, unauthorized human intervention or any other cause beyond the control of the Sweepstakes Sponsor, which could corrupt or affect the administration, security, impartiality or normal running of this Sweepstakes subject to the approval of the Régie des alcools, des courses et des jeux du Québec.
QUEBEC RESIDENTS
22. Any dispute regarding the organization or conduct of this Contest may be submitted to the “Régie” for a ruling. Any dispute regarding the awarding of a prize may be submitted to the “Régie” in order for the parties to reach a settlement.
